Plath received a citation for “possession of open container in motor vehicle” when she was 19 years old on April 7, 1991, In Touch confirmed. According to Florida law, an “open container” means she had an alcoholic beverage while riding in the passenger seat of a car. Plath was found guilty, and the case is currently closed.

June 2022

On June 10, 2022, Plath was involved in a car crash ahead of her DUI arrest. According to an incident report from Florida Highway Patrol exclusively obtained by In Touch, a police officer noticed a “single vehicle crash” in the Port Leon Drive area in Florida at around 11:52 p.m. The officer noted the car was traveling south along the road and made a lefthand turn before they “overturned.” The car eventually ended up resting on “its roof in a ditch (filled with water).” Plath was “still in the driver’s seat” when a witness and another officer helped her out of the car, the report explained. “Ms. Plath was already in the back of an ambulance when [the officer] arrived,” the documents stated, adding that Plath “appeared to be intoxicated and had a strong odor of an alcoholic beverage emitting from her breath and person.” Police then screened Plath “for a possible DUI violation.” “I observed Ms. Plath had several scrapes/lacerations on the bridge of her nose and facial area,” the Florida Highway Patrol officer explained in the report. “Ms. Plath had dried blood on her face and blood in her mouth. Ms. Plath was in a cervical collar and was sitting up on the stretcher as she was brought into the Emergency Room. Ms. Plath was conscious, appeared to be in a daze and had very red glassy eyes. Ms. Plath displayed Ptosis (droopy eyelids) and Mydriasis (dilated pupils).” In addition to the smell of alcohol on Plath, police observed that she “had very slow lethargic, uncoordinated movements as she would wipe at her eyes.” Plath admitted to drinking “two 12-ounce margaritas” and police concluded she “was under the influence of alcohol and was unable to operate a vehicle safely.” She was first charged with careless driving, though the charge was updated to DUI after Plath took a voluntary blood test. “On September 3, 2022, I received the toxicology report from FDLE Lab,” the officer continued in the statement. “The results of the blood test for Ms. Plath was a .161 and .162 BAC [blood alcohol content.] I completed a Warrant Affidavit on Ms. Plath for DUI (Property Damage), 316.193.3c1 and issued a UTC for Careless Driving.”

Plath’s DUI case was reopened in May 2023, according to legal documents obtained by In Touch. In a surprising twist, Plath identified her new boyfriend, Ken Palmer, as part of her case. The reality TV star filed an order on April 3, 2023, to dismiss the impoundment and immobilization of her vehicle, and additionally submitted an affidavit to the Wakulla County, Florida, court. She claimed that the car she was driving during the June 2022 incident was completely totaled, and that she had two other vehicles in her name. One of them, according to Plath, was being driven by son Isaac Plath, while the other was being used by Palmer. The motion and hearing were ultimately canceled and the case was closed on April 14.

Welcome to Plathville star Kim Plath made headlines when she was arrested on a warrant for driving under the influence (DUI) in October 2022. However, it is not the first time the reality star has found herself in trouble with law enforcement.

The arrest took place in Wakulla County, Florida, In Touch exclusively confirmed on October 20.

“She came to the Sheriff’s Office to turn herself in on a warrant from outside of our agency,” a Public Information Officer for the Wakulla County Sheriff’s Office told In Touch in a statement. The DUI includes charges of property damage/personal injury, according to documents exclusively obtained by In Touch.

The October warrant arrest was in relation to the reality star’s drunk driving incident that occurred on June 10, 2022, In Touch exclusively confirmed. Plath was initially charged with careless driving under the case type “traffic infraction” in Wakulla County in Crawford, Florida. On September 8, the charge was updated to a pending DUI charge.

Plath is best known for starring on Welcome to Plathville alongside her estranged husband, Barry Plath, and their kids: MoriahEthanMicahLydiaHosanna and Isaac.

The reality show documents the former couple and their kids as they live a strict and religious lifestyle that includes no alcohol.

Plath has been open about her experiences with alcohol on the show. In a previous episode, she explained to Moriah that her past home life inspired the strict rules she raised her kids under.

“I grew up with a single alcoholic mother,” Plath revealed to her eldest daughter. “I didn’t have a family. I didn’t have a home life. I didn’t have a dad. I had a mom when she was there, and she was sober, but for the most part, I raised myself. I have tried really hard to make sure you have a family to grow up in.”

She also shared that her own educational experience influenced her to form a negative perception on college, associating it with “drinking and partying.” Due to the experience, Plath and Barry did not support Moriah’s dreams to continue her education.

On the show, the TLC star reflected on how different her fate could have been if she had stayed on the path she was on while still a college student.

“I could have died so many different ways when I was in college, and by God’s grace, I came out of it, and he saved me and I live a different life now,” Plath noted. “But to me, the better thing would be for her to not have to experience all of the junk that I’ve experienced.”
